Culture of Germanic tribes and Written Records




Common elements of Germanic society can be deduced both from Roman historiography and comparative evidence from the Early Medieval period.

A main element uniting Germanic societies is kingship, in origin a sacral institution combining the functions of military leader, high priest, lawmaker and judge. Germanic monarchy was elective; the king was elected by the free men from among eligible candidates of a family (OE cynn) tracing their ancestry to the tribe's divine or semi-divine founder.

In early Germanic society, the free men of property each ruled their own estate and were subject to the king directly, without any intermediate hierarchy as in later feudalism. Free men without landed property could swear fealty to a man of property who as their lord would then be responsible for their upkeep, including generous feasts and gifts. This system of sworn retainers was central to early Germanic society, and the loyalty of the retainer to his lord was taken to replace his family ties.

Early Germanic law reflects a hierarchy of worth within the society of free men, reflected in the differences in weregild. Among the Anglo-Saxons, a regular free man (a ceorl) had a weregild of 200 shillings (i.e. solidi or gold pieces), classified as a twyhyndeman "200-man" for this reason, while a nobleman commanded a fee of six times that amount (twelfhyndeman "1200-man"). Similarly, among the Alamanni the basic weregild for a free man was 200 shillings, and the amount could be doubled or tripled according to the man's rank. Unfree serfs did not command a weregild, and the recompense paid in the event of their death was merely for material damage, 15 shillings in the case of the Alamanni, increased to 40 or 50 if the victim had been a skilled artisan.

The social hierarchy is not only reflected in the weregild due in the case of the violent or accidental death of a man, but also in differences in fines for lesser crimes. Thus the fines for insults, injury, burglary or damage to property differ depending on the rank of the injured party.[33] They do not usually depend on the rank of the guilty party, although there are some exceptions associated with royal privilege.[34]

Free women did not have a political station of their own but inherited the rank of their father if unmarried, or their husband if married. The weregild or recompense due for the killing or injuring of a woman is notably set at twice that of a man of the same rank in Alemannic law.

All freemen had the right to participate in general assemblies or things, where disputes between freemen were addressed according to customary law. The king was bound to uphold ancestral law, but was at the same time the source for new laws for cases not addressed in previous tradition. This aspect was the reason for the creation of the various Germanic law codes by the kings following their conversion to Christianity: besides recording inherited tribal law, these codes have the purpose of settling the position of the church and Christian clergy within society, usually setting the weregilds of the members of the clerical hierarchy parallel to that of the existing hierarchy of nobility, with the position of an archbishop mirroring that of the king.

In the case of a suspected crime, the accused could avoid punishment by presenting a fixed number of free men (their number depending on the severity of the crime) prepared to swear an oath on his innocence. Failing this, he could prove his innocence in a trial by combat. Corporal or capital punishment for free men does not figure in the Germanic law codes, and banishment appears to be the most severe penalty issued officially. This reflects that Germanic tribal law did not have the scope of exacting revenge, which was left to the judgement of the family of the victim, but to settle damages as fairly as possible once an involved party decided to bring a dispute before the assembly.

Traditional Germanic society was gradually replaced by the system of estates and feudalism characteristic of the High Middle Ages in both the Holy Roman Empire and Anglo-Norman England in the 11th to 12th centuries, to some extent under the influence of Roman law as an indirect result of Christianization, but also because political structures had grown too large for the flat hierarchy of a tribal society. The same effect of political centralization took hold in Scandinavia slightly later, in the 12th to 13th century (Age of the Sturlungs, Consolidation of Sweden, Civil war era in Norway), by the end of the 14th century culminating in the giant Kalmar Union. Elements of tribal law, notably the wager of battle, nevertheless remained in effect throughout the Middle Ages, in the case of the Holy Roman Empire until the establishment of the Imperial Chamber Court in the early German Renaissance. In the federalist organization of Switzerland, where cantonal structures remained comparatively local, the Germanic thing survived into the 21st century in the form of the Landsgemeinde, albeit subject to federal law.

Though often defeated by the Romans, the Germanic tribes were remembered in Roman records as fierce combatants, whose main downfall was that they failed to unite successfully into one fighting force, under one command.[ citation needed ] After the three Roman legions were ambushed and destroyed by an alliance of Germanic tribes headed by Arminius at the Battle of the Teutoburg Forest in 9 AD, the Roman Empire made no further concentrated attempts at conquering Germania beyond the Rhine. Germanic tribes would eventually overwhelm and conquer the ancient world, giving rise to modern Europe and medieval warfare. 3. Germanic tribes: runic inscriptions, gothic inscriptions, oldest form of the runic alphabet, used by Germanic tribes for Northwest Germanic and Migration period Germanic dialects of the 2nd to 8th centuries for inscriptions on artifacts such as jewellery, amulets, tools, weapons and runestones. In Scandinavia, the script was simplified to the Younger Futhark from the late 8th century, while the Anglo-Saxons and Frisians extended the Futhark which eventually became the Anglo-Saxon futhorc after Proto-English /a/ developed to /o/ in nasal environments.

Unlike the Younger Futhark, which remained in use until modern times, the knowledge of how to read the Elder Futhark was forgotten, and it was not until 1865 that the Norwegian scholar Sophus Bugge managed to decipher it.

The Elder Futhark (named after the initial phoneme of the first six rune names: F, U, Th, A, R and K) consist of twenty-four runes, often arranged in three groups of eight runes called an ætt. [2] In the following table, each rune is given with its common transliteration:

þ corresponds to [θ]. ï is also transliterated as æ, and may have been either a diphthong, or a vowel near [ɪ] or [æ]. z was Proto-Germanic [z], and evolved into Proto-Norse [ɹ], and is also transliterated as R. The remaining transliterations correspond to the IPA symbol of their approximate value.

The earliest known sequential listing of the alphabet dates to 400 and is found on the Kylver Stone in Gotland:

Two instances of another early inscription were found on the two Vadstena and Mariedamm bracteates (6th century), showing the division in three ætts, with the positions of ï, p and o, d inverted compared to the Kylver stone:

The Grumpan bracteate presents a listing from 500 which is identical to the one found on the previous bracteates but incomplete:

The Elder Futhark runes are commonly believed to originate in the Old Italic scripts: either a North Italic variant (Etruscan or Raetic alphabets), or the Latin alphabet itself. Derivation from the Greek alphabet via Gothic contact to Byzantine Greek culture was a popular theory in the 19th century, but has been ruled out since the dating of the Vimose inscriptions to the 2nd century (while the Goths had been in contact with Greek culture only from the early 3rd century). Conversely, the Greek-derived 4th century Gothic alphabet does have two letters derived from runes, (from Jer) and (from Uruz).

The angular shapes of the runes, presumably an adaptation to the incision in wood or metal, are not a Germanic innovation, but a property that is shared with other early alphabets, including the Old Italic ones (compare, for example, the Duenos inscription). The 1st century BC Negau helmet inscription features a Germanic name, Hariagastiz, in a North Etruscan alphabet, and may be a testimony of the earliest contact of Germanic speakers with alphabetic writing. Similarly, the Meldorf inscription of 50 may qualify as "proto-runic" use of the Latin alphabet by Germanic speakers. The Raetic "alphabet of Bolzano" in particular seems to fit the letter shapes well[3] The spearhead of Kovel, dated to 200 AD, sometimes advanced as evidence of a peculiar Gothic variant of the runic alphabet, bears an inscription tilarids that may in fact be in an Old Italic rather than a runic alphabet, running right to left with a T and a D closer to the Latin or Etruscan than to the Bolzano or runic alphabets. Perhaps an "eclectic" approach can yield the best results for the explanation of the origin of the runes: most shapes of the letters can be accounted for when deriving them from several distinct North Italic writing systems: the p rune has a parallel in the Camunic alphabet, while it has been argued that d derives from the shape of the letter san (= ś) in Lepontic where it seems to represent the sound /d/.[4]

The f, a, g, i, t, m and l runes show no variation, and are generally accepted as identical to Old Italic or Latin F, A, X, I, T, M and L. There is also wide agreement that the u, r, k, h, s, b and o runes correspond directly to V, R, C, H, S, B and O.

The runes of uncertain derivation may either be original innovations, or adoptions of otherwise unneeded Latin letters. Odenstedt (1990:163) suggests that all 22 Latin letters of the classical Latin alphabet (1st century, ignoring marginalized K) were adopted (þ from D, z from Y, ŋ from Q, w from P, j from G, ï from Z), with two runes (p and d) left over as original Germanic innovations, but there are conflicting scholarly opinions regarding the e (from E?), n (from N?), þ (D or Raetic Θ?), w (Q or P?), ï and z (both from either Z or Latin Y?), ŋ (Q?) and d runes.[5]

Of the 24 runes in the classical futhark row attested from 400 (Kylver stone), ï, p [6] and ŋ [7] are unattested in the earliest inscriptions of ca. 175 to 400, while e in this early period mostly takes a Π-shape, its M-shape () gaining prevalence only from the 5th century. Similarly, the s rune may have either three () or four () strokes (and more rarely five or more), and only from the 5th century does the variant with three strokes become prevalent.

Note that the "mature" runes of the 6th to 8th centuries tend to have only three directions of strokes, the vertical and two diagonal directions. Early inscriptions also show horizontal strokes: in the case of e mentioned above, but also in t, l, ŋ and h.
