The First President of the Republic of Kazakhstan




The Head of state. The President of the Republic of Kazakhstan.

The head of state or chief of state is the highest-ranked official position in a sovereign state. The head of state is vested with powers to act as the chief public representative of that state. Heads of state in most countries are natural persons holding an office, an official.

The term head of state is often used differentiating it from the term head of government, e.g. as in article 7 of the Vienna Convention on the Law of Treaties, article 1 of the Convention on the Prevention and Punishment of Crimes against Internationally Protected Persons, including Diplomatic Agents and the United Nations protocol list. For instance, in parliamentary systems like the United Kingdom of Great Britain and Northern Ireland and the Federal Republic of Germany; the Monarch and the President are recognized as their respective heads of state, while the Prime Minister and the Chancellor are recognized as the heads of government. However, in republics with a presidential system, as in the United States and the Federative Republic of Brazil, their presidents are recognized as being both heads of state and heads of government. The latter is also generally true in absolute monarchies and sometimes as well in other forms of authoritarian government.

The role of the head of state generally includes legitimizing the state and exercising the functions and duties granted to the head of state in the country's constitution, laws, unwritten customs, or by their traditions. The Vienna Convention on Diplomatic Relations operates under the presumption that the head of a diplomatic mission (i.e. ambassador or nuncio) of the sending state is accredited to the head of state of the receiving state. In nation states the head of state position is often thought of, depending on the powers held by that position, as either the official "leader" or "mascot" of the nation.

Charles de Gaulle described the role he envisaged for the French presidency before he wrote the modern French constitution, stating the head of state should embody "the spirit of the nation" for the nation itself and the world: "a certain idea about France". Today, many countries expect their head of state to embody their national values with dignity in a similar fashion.

The First President of the Republic of Kazakhstan, who has spearheaded the creation of Kazakhstan’s statehood and who made outstanding contributions to the development of sovereign Kazakhstan as a democratic, secular, legal and social state, is the Leader of the Nation. At the First President of the Republic of Kazakhstan - the Leader of the Nation – does not apply restrictions on the right to be elected President of the Republic of Kazakhstan.

First President of the Republic of Kazakhstan - the Leader of the Nation - by virtue of his historical mission during all his life has the right:

1) to appeal to the people of Kazakhstan, government agencies, and officials with the initiatives on major issues of state construction, domestic and foreign policy and national security, which are subject to consideration by the relevant government authorities and officials;

2) to address to the Parliament of the Republic of Kazakhstan and its chambers, at meetings of the Government of the Republic during the discussion of important issues for the country, lead the Assembly of Peoples of Kazakhstan, be a member of the Constitutional Council, the Security Council of the Republic of Kazakhstan. Elaborating initiatives on key areas of domestic and foreign policies shall be coordinated with the First President of the Republic of Kazakhstan- the Leader of the Nation. Impeding the legitimate activities of the First President of the Republic of Kazakhstan - the Leader of the Nation, public insult or other infringement upon the honor and dignity of the First President of the Republic of Kazakhstan - the Leader of the Nation, as well as the desecration of images of the First President of the Republic of Kazakhstan - the Leader of the Nation are not allowed and will be punishable by law.

The President of the Republic shall be elected by universal, equal and direct suffrage under a secret ballot for a seven-year term in accordance with the constitutional law by the citizens of the Republic who have come of age. A citizen of the Republic shall be eligible for the office of the President of the Republic of Kazakhstan if he is by birth not younger than forty and has a perfect command of the state language and has lived in Kazakhstan for not less than fifteen years.

The President of the Republic of Kazakhstan, on the basis of and with the exercise of the Constitution and the laws, shall issue decrees and resolutions which are binding on the entire territory of the Republic.

Nursultan Äbishuly Nazarbayev (Kazakh: Нұрсұлтан Әбішұлы Назарбаев; born 6 July 1940) is the First President of Kazakhstan. He has been the country's leader since 1989, when he was named Secretary General of the Communist Party of the Kazakh SSR, and was elected the nation's first president following its independence from the Soviet Union in December 1991. In April 2011, Nazarbayev was re-elected to another five-year term.

The President's "honor and dignity shall be inviolable" and that his expenses shall be paid by the state. Item 4 of the article outlines the special status and authority of the first president, and refers to a special constitutional act for definitions. According to this act, the first president possesses total, absolute and termless inviolability for all actions he performs during his being on a post. And till the death he sustains the government official. He also keeps ability to speak to people of Kazakhstan, keeps guards, communication, transport, state support of his activity, and official apartment and summer residence became his property with official maintenance. There is also pointed medical care, sanatorium, provision of pensions and insurance.
