UNIT 5. THE ADMINISTRATIVE LAW OF THE REPUBLIC OF KAZAKHSTAN

Administrative law refers generally to the laws and legal principles governing the creation, administration and regulation of government agencies at the state, and local levels. It is essentially ―the powers granted to administrative agencies, the substantive rules that such agencies make, and the legal relationship between such agencies, other government bodies, and the public at large.

Branch of law governing the creation and operation of administrative agencies. Of special importance are the powers granted to administrative agencies, the substantive rules that such agencies make, and the legal relationships between such agencies, other government bodies, and the public at large.

The administrative law is a set of the rules of law governing the public relations in the sphere of public administration.

Public administration as one of types of the state activity consists in executive and administrative activity of special government bodies for the management of various areas of public life.

1. Public control is exercised special subjects - state bodies.

2. The main activity in the course of public administration - performance of laws and other regulations.

3. Relative independence of executive bodies of the state of governmental bodies of the state. This independence follows from the principle of division of the authorities enshrined in the Constitution of RK.

4. Existence of material resources at executive bodies to which are subordinated the state enterprises, establishments, and organization.

5. Legally domineering character of public administration that means investment of executive bodies with powers of authority.

6. Comprehensive nature of public administration. It covers the important parties of public life regulated by the right.

7. Public administration has subordinate character. It is carried out on the basis of laws and has to correspond to regulations.

This is the main line of public administration.

Functions of public administration are presented by the types of administrative activity defining their purposes. The main functions treat:

1. forecasting and planning;

2. organization;

3. regulation;

4. management and coordination;

5. control.
