The rules of Administrative law

The administrative rules of law are the rules of behavior governing the public relations in the sphere established by the state public administration. Their logical structure is traditional for all rules of law are a hypothesis (the legal facts), a disposition (the rule of behavior) and the sanction (the measure applied in cases of violation of requirements of these norms).

Types of administrative rules of law are classified by various bases:

1. according to the legal contents;

2. according to the material and procedural contents;

3. depending on the addressee of standard instructions;

4. on regulation volume;

5. on validity;

6. on a coverage;

7. on action in time;

8. on action in space.

Every person in Kazakhstan in administrative relations can be in two main qualities: as subjects of subordination or as active participants in these relations.

For that citizens of Kazakhstan should have administrative capacity (it occurs at birth and ceases at death) and age (fully mature in 18 years).

The next element of the administrative and legal status of citizens of the Republic of Kazakhstan is the rights and obligations in the sphere of public administration.

The administrative and legal status of foreigners and stateless persons is follows: persons, who are not citizens of the Republic of Kazakhstan, shall enjoy all rights and freedoms, and also bear all the responsibilities established by the Constitution of Kazakhstan, laws and international treaties of the Republic of Kazakhstan. All foreigners on the territory of Kazakhstan can be divided into three major groups: citizens temporarily residing in the country, citizens permanently residing in the Republic of Kazakhstan and the citizens, passing through the territory of the Republic of Kazakhstan in transit, although in general they have the same rights and responsibilities as citizens of Kazakhstan for they contain certain exceptions or limitations:

· they are not subject to military duty;

· they cannot be the civil servants, except of the personal order of the President of Kazakhstan and international treaties.

· they have a duty to notify the law enforcement authorities of the trip on the territory of the Republic of Kazakhstan (for temporary residents);

· they are obliged to register passports (for temporary residents) and perform a series of actions envisaged by the Constitution of Kazakhstan and other laws, international treaties and agreements;

· deprived of political rights (to vote, to be elected, to be a member of the political party).
