What is the concept of "land" as a legal category? Under the legislation it is denoted by the surface of the globe, which is within the national borders of Kazakhstan. Legally significant characteristic of land is that unlike soil land can not be separated from the surface of the globe. Not by chance since the days of the Roman Law is considered the land of real estate. In characterizing the concept of "land", for example, as an object of property rights, focusing on the spatial boundaries of the land or land.

One of the basic principles of land use is the principle of land use strictly in accordance with the purposes for which the lands were presented.

Such measures are implemented through the establishment of rules of state land cadaster, land monitoring, and provision of land acquisition, project development and implementation of land management, land use by enterprises, institutions, organizations and citizens.

In the legal sense, means the part of the subsoil beneath the Earth's crust below the soil, and in his absence - below the earth's surface and the bottom of ponds and drains, extending to depths available for exploration and development. This definition is contained in the preamble to the bowels of the RK Law "On Subsoil and Subsoil Use". The usefulness of the subsoil for the individual and society is that they are the source of the material feedstock, fossil fuels and other materials, mineral resources satisfy scientific requirements.

They are used for the construction of underground structures and communications - such as warehouses, storage facilities, subway lines, pipelines, and so on. All these properties of the measures taken into account when designing a system of measures for their legal protection.

Besides the common minerals that can be mined owners and owners of land freely, all other types of subsoil use are carried out only based on the license. The position on the licensing of subsoil use the following types of licenses:

- Geological studies;

- Extraction of minerals;

- The right of the construction and operation of underground facilities not related to mining;

- The right to education of protected objects.

RK Law "On Subsoil and Subsoil Use" defines the basic requirements for the rational use and conservation of resources. These are:

-providing complete geological study, rational complex use and protection of mineral resources; conducting advance geological study, to provide reliable estimates of mineral reserves, or the properties of subsurface area provided for use for purposes not related to mining;

- State examination and public accounting of mineral reserves, as well as subsoil used for purposes not related to mining;

- Ensuring the most complete extraction of subsoil reserves of basic and together with them occurring minerals and associated components;

- Reliable accounting extracted and left in the bowels of the stock of fixed and shared with them occurring minerals and associated components in the development of mineral deposits;

- The protection of mineral deposits from flooding, flooding, fires and other factors that reduce the quality of mineral and commercial value of deposits or complicating their development;

- Prevention of pollution of subsoil in the works related to subsoil use, especially for underground storage of oil, gas or other substances and materials, dumping of hazardous materials and waste products, wastewater discharges;

-compliance established order preservation and liquidation of enterprises in mining and underground facilities not related to mining;

- The prevention of unauthorized building areas of mineral deposits and adherence to the order of use of these areas for other purposes;

- Prevent the accumulation of industrial and domestic waste water intake on the squares and in situ groundwater used for drinking or industrial water supply.
