A legal state and a civil society

A legal state is a state, in which the law dominates, citizens are under reliable legal defence in this state, there is mutual responsibility between a person and a state. This is the state of real human rights, it is an instrument of providing of such rights.

There are attributes of a legal state:

- domination of the law in public and state life, supremacy of the law;

- domination of folk sovereignty. People must be the source of state power. The state forms the system of bodies of state power through representative or direct democracy;

- fundamental human rights are fixed in the constitution and other legal documents. The law spreads not only on citizens but also on a state, all bodies of state power, public organizations and public officers;

- state power is divided into legislative, executive and judicial;

- the state provides rights and freedoms of a person;

- inviolability of rights, freedoms and interests, honour and dignity of a person, legal security of a person;

- mutual responsibility of a state and a person, equality all before the law;

- professionalism of the bodies of state power and public officers, which create legal norms (rules);

- independence of judicial power from other branches of power;

- control and supervision for implementation of the laws and mode of legality by all participants of public relations;

- high level of culture in a society and legal consciousness of all legal subjects, presence of legal knowledge.

According to the Constitution of Ukraine our state is legal.

A civil society is a society of citizens with the high level of economic, social, political, culture and moral properties. A civil society forms legal relations with a state. A civil society is a society of equal people in their rights and freedoms. A legal state provides legal possibilities to be owners for them, to participate in political life.

There are attributes of a civil society:

- the main social values are people and their rights;

- priority of a society above a state, which is the regulator of public relations and realizes rights;

- providing of economic freedom of citizens and their associations;

- presence of pluralism (varieties) in all spheres of material and spiritual life;

- equality of rights and security of all forms of ownership first of all private;

- reliable system of social defence of a person;

- ideological, political individual freedom, presence of democratic institutes and methods, which provide possibility to influence on realization of the state policy for everybody.

In Ukraine a civil society is on the stage of forming.
